1. Who we are

The App is provided by Poikilingo ApS (CVR DK41942185), Guldringen 27, 4320 Osted, Lejre, Denmark. Contact: support@poikilingo.com.

2. Children and parental responsibility

The App is designed for young children, but it must be downloaded, installed, and set up by a parent or legal guardian (or another adult authorised by them). By accepting these Terms you confirm that you are an adult with the authority to agree on behalf of the child using the App. Parents are responsible for supervising their child’s use of the App; the App includes optional screen-time settings to support this.

3. Licence to use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for private, non-commercial purposes, in accordance with these Terms and the applicable app store rules (Apple App Store or Google Play). We remain the owner of the App; the App is licensed to you, not sold.

4. Subscriptions and payment

The App is free to download and contains no advertising. Part of the content is free; the rest is unlocked with an optional auto-renewing subscription, offered monthly or yearly. Purchases are made through the app store you installed the App from (Apple App Store or Google Play) and are subject to that store’s own terms. All purchases sit behind a parental gate.

Free trial. Where a free trial is offered, its length is shown on the purchase screen before you subscribe. If you do not cancel before the trial ends, the subscription begins and the first payment is taken automatically. Any unused part of a free trial is forfeited when a subscription is purchased.

Renewal. Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the end of the current period. Payment is charged to your store account on confirmation of purchase, and again within the 24 hours before each renewal.

Cancelling. You can cancel at any time in your store account settings — on Apple devices, Settings → your name → Subscriptions; on Android, the Play Store subscriptions screen. Cancelling stops the next renewal; it does not end the period already paid for, and access continues until that period ends. We cannot cancel a subscription on your behalf.

Prices and refunds. Prices are shown in your local currency on the purchase screen before you buy and vary by country or region. If a price changes, the store will ask for your consent before the new price applies. Refunds are handled by the app store, not by Poikilingo ApS, under that store’s refund policy.

What a subscription gives you. Access to the content described on the purchase screen at the time you subscribe, for as long as the subscription is active. Content is added and occasionally changed over time (see clause 6).

5. Intellectual property

All content in the App — including illustrations, animations, audio recordings, text, translations, characters (such as Poiki), and software — is owned by or licensed to Poikilingo ApS and is protected by copyright and other intellectual-property laws. You may not copy, distribute, sell, publicly display, or create derivative works from the App or its content, or reverse-engineer or decompile the App, except where such a restriction is not permitted by applicable law.

6. Content and updates

Learning content (images, audio, text) may be delivered and updated over the internet, and the App may offer a parent-controlled offline download of content. We may add, change, or remove content and features at any time to improve the App. We do not guarantee that the App or any particular content will always be available or uninterrupted.

7. Acceptable use

You agree not to misuse the App. In particular, you may not use the App for any unlawful purpose, attempt to circumvent its parental gate or other protections, interfere with our content delivery systems, or use the App’s content outside the App without our permission.

8. Privacy

Our handling of information in connection with the App is described in the App’s Privacy Policy. The App is designed for children and does not require an account, does not show advertising, and does not sell personal information.

9. Educational content — no guarantees

The App is designed to support playful language learning. We do not promise any specific learning outcome, and the App is not a substitute for formal education or professional advice.

10. Disclaimer and limitation of liability

The App is provided “as is” and “as available”. To the maximum extent permitted by applicable law, we disclaim all warranties and shall not be liable for indirect, incidental, or consequential damages arising from the use of, or inability to use, the App. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, and nothing affects your statutory rights as a consumer.

11. Termination

You may stop using the App at any time by uninstalling it. We may suspend or discontinue the App, or terminate this licence, if these Terms are breached or if we withdraw the App from distribution. Sections that by their nature should survive (such as intellectual property and limitation of liability) survive termination.

12. Changes to these Terms

We may update these Terms from time to time. Material updates will be reflected with a new effective date and appropriate notice. Continued use of the App after an update constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of Denmark. If you are a consumer resident in the EU or elsewhere, you also benefit from any mandatory consumer-protection provisions of the law of your country of residence, and disputes may be brought before the courts of that country.
